General terms and conditions for using the Connect by CNES website

Access to and use of the Connect by CNES website are governed by the provisions of these general terms and conditions of use.
In this respect, by accessing or using the Connect by CNES website, users are automatically bound by these terms and conditions of use, and by any subsequent modifications that may be made by CNES, at its sole discretion and without prior notice.
These general terms and conditions of use are governed by and interpreted in accordance with French law.
Any dispute relating to the interpretation or implementation of these general terms and conditions of use shall be submitted to the relevant court in Paris (France).
The Connect by CNES website disseminates non-contractual information related to the Agency's assistance and support for the innovation ecosystem in the space sector and space applications run by CNES.

Liability

All the data and content on the Connect by CNES website are the property of CNES, or the property of a third party which has granted CNES the right to use them.

The data and content are accessible in the state in which they are made available on the website and with no guarantees of any kind.
CNES therefore neither guarantees nor claims that, without limitation, (i) this service and its components meets your requirements, (ii) this service and its components will not be subject to periodic interruption, without failure or error, (iii) the data disseminated via the Connect by CNES website are accurate, up-to-date or reliable, (iv) the quality of the data meets users’ expectations and that the data are free from errors or defects, or that any potential errors will be corrected. Access to and use of the Connect by CNES website is under the user's own responsibility.

Under no circumstances shall CNES be held liable for any direct or indirect damage, or any subsequent or other damage that may result from access to, use of, or unavailability of the Connect by CNES website or the websites linked to it (in particular the external non-affiliated websites used to register for the events organised by Connect by CNES), including loss of data or programs, interruptions, changes, updates, modifications to data published on the Connect by CNES website, the occurrence of program bugs, loss of use, financial loss, any deterioration or infection of the users’ equipment by viruses (including but not limited to software, hardware, connections and any systems or networks).
CNES reserves the right to make temporary or permanent changes, updates, interruptions or modifications to any data published on the Connect by CNES website, including the selection and layout of the data, or its services, at any time and without prior notice.

CNES cannot be held liable for any costs, losses and expenses resulting from any non-compliance with this legal notice, or linked to the use of or access to the Connect by CNES website.
Users shall not intentionally or unintentionally insert viruses or files that may disrupt the operation of the Connect by CNES website. Users shall be fully liable in this case.
Users shall not access or use the Connect by CNES website for illegal or prohibited purposes.

Confidentiality - Personal data

When using the Connect by CNES website, personal data may be collected in order to facilitate the operation of the Connect by CNES ecosystem (putting registered professional experts in touch with each other, informing users of the Connect by CNES website, organising events, newsletters, etc.).

With this in mind, the following information pertaining to registered professional stakeholders will be recorded:
Title, last name, first name, nationality, job title, expertise and email address of the registered professional expert, and  
Name, address and sector of activity of the company that employs the person. Users may add a photo of themselves.
 
This information is collected by filling in an online form and is saved in a computer file by the CNES Innovation, Applications and Science Directorate, for statistical purposes. The legal basis for the processing is user consent.
The data collected are shared among the users of the site.
The data are kept until the user has deleted his/her profile.
The information concerning the last name, first name and expertise of the registered professional expert, as well as the name and address of the his/her employer, are also made available to the other registered professional experts in the network, in a directory.

The initial contact between professional experts who have registered on the Connect by CNES network is anonymous: the recipient's electronic contact details do not appear when the initial contact is made and are only communicated to the sender if the recipient replies.

To send information relating to events organised by the Connect by CNES network or their partners, the Connect by CNES website uses the Druppal tool, which generates lists of e-mail addresses communicated by website users when joining the Connect by CNES network and/or subscribing to the newsletter.
These lists are used by CNES and, where applicable, by service providers or partners, exclusively for organising events initiated by Connect by CNES. Submitting an application for membership or subscribing to a newsletter implies that you accept to be included on these lists.   
For any other data that may be collected by means of applications offered via Connect by CNES (for example NetWork Meetings), CNES will inform users of the purpose and will identify the person responsible for processing and storing the personal data (data controller).
Newsletter subscription: your data will be kept for the duration of your subscription.

Cancellation of the subscription, accessible via the "unsubscribe" link on the Connect by CNES website or at the bottom of the Newsletter page, implies the deletion of the data concerning the registered user.
Apart from cases about which users are explicitly notified, the personal data are processed on a confidential basis by CNES and are not shared or transferred to third parties.

In accordance with Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data, users of the Connect by CNES website have the right to access their data. They also have the right to rectify them, to request their erasure or to exercise their right to restrict the processing of their data. Furthermore, users can withdraw their consent to the processing of their data at any time; they can also object to the processing of their data and they may also exercise their right to the portability of their data.

If the user considers, after contacting us, that his/her "Information Technology and Liberties" rights have not been respected, he/she shall be entitled to file a complaint with the CNIL.

Links

CNES shall not be held liable for the access to, content and use of third party websites referenced by links, including, but not limited to, the collection of personal data, or the installation of cookies by such sites.
Users assume all risks linked to accessing such third-party sites through referenced links.

Cookies

This site may use cookies (small data files whose purpose is to keep track of the users’ connections). CNES may access these data and save them during the users' visits, without the intention of identifying the users. Users can modify the personal configuration of their browser to prevent the cookies from being saved.

Intellectual property rights

All intellectual property rights pertaining to the Connect by CNES website, including but not limited to those relating to patented data, copyrights, trade names, trademarks, logos, databases, documents, texts, graphics, drawings, photographs, audio files, video files and digital circuits, belong to CNES, or to a third party which has granted CNES the right to use them.
Unless otherwise stipulated in writing, the access to and use of the Connect by CNES website shall not be interpreted as granting or guaranteeing any rights whatsoever concerning the use of these intellectual property rights.

Rights granted

CNES grants users a personal, free, non-exclusive and non-transferable right of access to and use of the Connect by CNES website. Any other rights are expressly excluded.

Consequently, and in a non-exhaustive manner, it is expressly and formally forbidden to (i) reproduce, represent, adapt and/or translate, (ii) extract, or (iii) create any work that derives from all or part of the Connect by CNES website and/or related content, unless for the strictly limited use of private copies or for educational purposes.

In the case of private or educational copies, any reproduction of the data by the user must be accompanied by the following clearly-legible statement: “This document has been taken from the Connect by CNES website. Protected information - All rights reserved © CNES (+ year of publication)”.
